In two cases\u2014set forth by paragraph\u202f1\u2011bis of Article\u202f4 of Law No.\u202f91\/1992 and paragraph\u202f1\u2011ter of Article\u202f1 of Decree\u2011Law No.\u202f36\/2025\u2014minor children born abroad to a parent who does not automatically transmit citizenship may acquire Italian citizenship.<\/p>\n
These minor children are not citizens by birth nor via iure sanguinis.<\/p>\n
Under Article\u202f15 of Law No.\u202f91\/1992, the child does not acquire citizenship from the day of birth, but from the day following the fulfillment of legal conditions.<\/p>\n
All of the following must apply:<\/p>\n
One of the parents must be a citizen by birth (naturalized citizens under Article\u202f9 of Law\u202f91\/1992, or citizenship \u201cby law benefit\u201d under Article\u202f4, or by marriage under Articles\u202f5 or\u202f10, or reacquisition under Articles\u202f13 or\u202f17, or via iure communicatione<\/em> under Article\u202f14 are excluded).<\/p>\n<\/li>\n Both parents (including the non\u2011citizen parent) or the legal guardian must submit a declaration of intent to acquire citizenship within one year of the child\u2019s birth (or later date when parentage or adoption by an Italian citizen is established). If parentage is recognized later by two Italian birth\u2011citizen parents, the one\u2011year period starts from the first recognition. If one parent recognizes parentage first and is either foreign or a non\u2011birth Italian citizen, then the one\u2011year window begins when the second parent (birth\u2011citizen) recognizes.<\/p>\n<\/li>\n The declaration must be formal, made in person, before a civil\u2011status official. If parents do not declare at the same time, the legal requirement is satisfied on the date of the second parent\u2019s declaration. If there is a single parent (or other parent deceased), one parent\u2019s declaration suffices.<\/p>\n<\/li>\n<\/ul>\n If the minor establishes legal residence in Italy, the declaration may be submitted after the one\u2011year term, provided the child remains a legal resident for at least two continuous years after the declaration is made by the parents.<\/p>\n Applies when:<\/p>\n The child was still a minor at the entry into force of the law (i.e. under 18 as of May\u202f24, 2025);<\/p>\n<\/li>\n The child is the son\/daughter of a citizen by birth, under cases a), a\u2011bis) or b) of Article\u202f3\u2011bis of Law\u202f91\/1992\u2014in other words, citizenship recognition based on administrative or judicial application submitted by 23:59 Rome time on March\u202f27, 2025, or appointment arranged by that date;<\/p>\n<\/li>\n A declaration by the parents or guardian must be submitted in person to the Consular Office by May\u202f31, 2026. If the child becomes of age before that date, they must declare personally before the same deadline.<\/p>\n<\/li>\n<\/ul>\n Declarations must be made in person at the Consular Office, in front of civil\u2011status staff.
